1 Platform Provider

In these Terms of Use, the company operating the Platform is referred to as the “Platform Provider”, “we”, “us” or “our”.

2 About the Platform

The Platform is an online qualification and candidate search platform operated by the Platform Provider. It enables Candidates to create professional profiles, complete Assessments, obtain Certificates and make their professional qualifications available to registered Employers.

Employers may search the Platform to identify Candidates whose qualifications match their recruitment needs. The Platform enables Candidates to demonstrate their professional knowledge and qualifications and enables Employers to identify potential Candidates based on professional information and Assessment Results.

The Platform is not a job advertisement platform and does not employ Candidates or make recruitment decisions.

3 Definitions

For the purposes of these Terms of Use:

• “Account” means a registered Candidate Account or Company Account created on the Platform.
• “Assessment” means any test, examination, questionnaire, knowledge check or other evaluation made available through the Platform.
• “Assessment Result” means the score, number of correct answers, pass or fail status, date of completion, satisfaction of specified criteria or other result generated following completion of an Assessment.
• “Candidate” means an individual who creates or uses a Candidate Account, maintains a professional profile, completes an Assessment or otherwise uses the Platform in an individual professional capacity.
• “Candidate Account” means an Account created by or for a Candidate.
• “Candidate Profile” means the professional profile associated with a Candidate Account, which contains Professional Information, Assessment Results, Certificates and other information provided by the Candidate through the Platform.
• “Certificate” means a certificate, confirmation, record or other document generated or displayed through the Platform in connection with an Assessment, qualification or professional credential.
• “Company Account” means an Account created on behalf of an Employer.
• “Company User” means a natural person authorised to access and use a Company Account on behalf of an Employer.
• “Employer” means an employer, prospective employer, or other professional organisation that uses the Platform to search for, assess, contact or consider Candidates.
• “Professional Information” means information concerning a Candidate’s education, employment history, professional experience, qualifications, skills, language proficiency, certificates, licences and other work-related characteristics.
• “Registered User” means a Candidate or Company User who has created or has been authorised to access an Account.
• “User” means any person who accesses or uses the Platform, whether or not that person has created an Account.

4 Who Can Use the Platform

The Platform is intended for:

• Candidates who are at least 18 years old and have the legal capacity to enter into these Terms;
• Employers authorised to create and use a Company Account on behalf of their organisation.

You are responsible for ensuring that the information you provide during registration remains accurate and up to date.

5 Creating an Account

Candidates create their own Candidate Accounts, while Employers create their own Company Accounts. You are responsible for:

• keeping your account information accurate;
• protecting your login credentials;
• preventing unauthorised access to your account;
• notifying us if you believe your account has been compromised; and
• all activities carried out through your Account unless you have notified us without undue delay that your Account has been compromised.

We may request additional information to verify your identity or, in the case of Employers, your authority to represent an organisation.

6 Candidate Profiles

Your Candidate Profile may include your professional information, qualifications, certificates, Assessment Results and other information you choose to provide through the Platform.

By creating a Candidate Profile, you acknowledge that the Platform is intended to enable registered Employers to search for and identify Candidates based on their professional qualifications. Subject to your visibility settings, registered Employers may view your professional information and Assessment Results through the Platform.

7 Assessments and Certificates

The Platform provides professional knowledge assessments that may be completed voluntarily by Candidates or at the request of an Employer. Assessment Results are generated using predefined assessment criteria, which may include minimum scores, correct answers or other assessment requirements. Assessment content, scoring methodology and passing criteria may vary depending on the Assessment.

Candidates may repeat Assessments where permitted by the applicable Assessment rules. Assessment Results and Certificates may be made available to the Candidate and, where applicable, to registered Employers through the Platform.

Assessments must be completed personally by the Candidate. Any attempt to cheat, impersonate another person or manipulate Assessment Results may result in suspension of the Account, invalidation of Assessment Results or withdrawal of Certificates. Where required, we may verify a Candidate’s identity before or after an Assessment.

8 Employment Disclaimer

The Platform is designed to assess professional knowledge and qualifications and to help Employers identify potential Candidates. Creating a Candidate Profile, completing an Assessment, achieving a particular score or receiving a Certificate does not guarantee:

• that an Employer will view your profile;
• that you will be contacted by an Employer;
• participation in a recruitment process;
• an offer of employment; or
• the conclusion of an employment contract.

All recruitment and hiring decisions are made independently by the relevant Employer. Employers remain solely responsible for their recruitment decisions and may consider Assessment Results together with professional experience, qualifications, interviews and any other information they consider relevant.

9 Your Responsibilities

When using the Platform, you agree to:

• provide accurate information;
• use the Platform honestly and lawfully;
• complete Assessments personally;
• respect the rights of other Users; and
• comply with these Terms.

Employers must use Candidate information only for genuine recruitment purposes and must not disclose, sell, licence or otherwise make Candidate information available to third parties unless permitted by applicable law or authorised by the relevant Candidate.

You must not:

• create an account using another person’s identity;
• provide false or misleading information;
• share your account credentials;
• interfere with the security or operation of the Platform;
• copy or distribute Assessment content without permission;
• use automated tools, scripts, bots or artificial intelligence to access, extract, copy or reproduce Platform content without our prior written permission;
• attempt to gain unauthorised access to another User’s Account; or
• use the Platform for unlawful or fraudulent purposes.

Employers may use Candidate information only for legitimate recruitment purposes and in accordance with applicable law.

10 Your Content

You remain responsible for the information and documents you upload to the Platform. By uploading content, you confirm that:

• you have the right to use and share it;
• it is accurate to the best of your knowledge; and
• it does not infringe the rights of others.

You retain ownership of your content. However, you grant us a non-exclusive licence to store, display and process it to operate the Platform and provide our services. We may remove or restrict access to content that violates these Terms, applicable law or the rights of another person.

11 Intellectual Property

The Platform, including its software, assessments, databases, trademarks and other content, is owned by or licensed to the Platform Provider and is protected by intellectual property laws. You may use the Platform only for its intended purpose and may not copy, reproduce, distribute or commercially exploit any part of it without our prior written permission.

12 Suspension and Termination

We may suspend, restrict or terminate your Account if you:

• breach these Terms;
• provide false information;
• misuse the Platform;
• manipulate Assessment Results;
• compromise Platform security; or
• use the Platform unlawfully.

Where appropriate, we may first ask you to correct the issue before restricting or terminating your access.

You may delete your Account at any time. Deleting your Account will remove your Candidate Profile from Employer searches. Certain information may continue to be retained as described in the Privacy Notice.

13 Platform Availability

We aim to keep the Platform available and secure at all times. However, temporary interruptions may occur due to maintenance, technical issues, security updates or circumstances beyond our reasonable control. We may modify or improve the Platform from time to time to enhance its functionality, security or compliance with applicable law.

14 Liability

We make reasonable efforts to ensure that the Platform is secure, reliable and operates as intended. However, we do not guarantee uninterrupted availability, that all information provided by Users is accurate or complete, or that use of the Platform will result in employment or recruitment opportunities.

The Platform Provider is not responsible for decisions or actions taken independently by Employers, including recruitment decisions, employment offers or employment agreements concluded between Employers and Candidates.

Nothing in these Terms excludes or limits liability where such limitation is prohibited by applicable law.

15 Changes to These Terms

We may update these Terms from time to time to reflect changes to the Platform, applicable law or our services. Where changes are material, we will notify registered Users before they take effect. By continuing to use the Platform after the updated Terms become effective, you agree to the revised Terms.

These Terms are governed by the laws of Estonia, without prejudice to any mandatory rights granted under applicable law.

17 Who We Are

Controller

The Platform is operated by:

For the purposes of the General Data Protection Regulation (EU) 2016/679 (“GDPR”), the Platform Provider is the controller of the personal data processed through the Platform for its own purposes, including operating the Platform, managing user accounts, providing Assessments, maintaining Candidate Profiles and enabling Employers to search for Candidates.

Where an Employer accesses Candidate information through the Platform for its own recruitment purposes, that Employer acts as an independent controller of the personal data it processes.

18 What Personal Data We Collect

Depending on how you use the Platform, we may collect and process the following categories of personal data:

Information you provide

• Identity and contact information — first name; surname; email address; telephone number; date of birth.
• Account information — username; user ID; registration date; authentication information; login history; session information.
• Professional information — CV; employment history; education; profession; professional skills; language proficiency; professional certificates; licences; other information you choose to include in your Candidate Profile.
• Documents — CV; profile photograph; certificates; licences; other professional documents.

Information generated through your use of the Platform

• Assessment information — Assessment completed; Assessment Result; score; pass or fail status; completion date; certificates issued; where applicable, your answers submitted during an Assessment.

Identity verification information

The Platform does not store copies of your passport, identity card or selfie images. We only receive and store information necessary to confirm the verification outcome, such as: verification status; verification result; verification identifier (where applicable); verification date.

Technical information

• IP address; browser and device information; operating system; system logs; security logs; information necessary to ensure Platform security and performance.

19 How We Obtain Your Data

We obtain personal data:

• directly from you when you create an Account, complete Assessments or update your Candidate Profile;
• automatically when you use the Platform;
• from identity verification providers where identity verification is required; and
• from information and documents you upload to the Platform.

20 How We Use Your Personal Data

We process your personal data to:

• create and manage your Account;
• authenticate your identity;
• maintain your Candidate Profile;
• provide Assessments;
• calculate and display Assessment Results;
• issue Certificates;
• enable Employers to search for Candidates;
• allow Employers to review professional qualifications and Assessment Results;
• perform identity verification;
• communicate with you;
• provide technical support;
• maintain Platform security;
• detect and prevent fraud;
• improve and develop the Platform;
• comply with legal obligations; and
• establish, exercise or defend legal claims where necessary.

21 Our Legal Bases

We process your personal data on one or more of the following legal bases:

Performance of a contract

We process your personal data to create and manage your Account, provide the Platform, maintain your Candidate Profile, provide Assessments and Certificates, and make your Candidate Profile available to Employers.

Legitimate interests

We process your personal data where necessary to maintain Platform security, prevent fraud, perform identity verification where appropriate, maintain, improve and develop the Platform, and establish, exercise or defend legal claims.

Legal obligation

We process personal data where necessary to comply with applicable legal obligations.

Consent

Where we rely on your consent, you may withdraw it at any time.

22 Who Can Access Your Information

Depending on your role and the Platform functionality, your personal data may be accessed by:

• you;
• authorised Platform administrators;
• authorised technical support personnel;
• registered Employers;
• service providers supporting the operation of the Platform.

Employers can access only the Candidate information made available through the Platform. They cannot access passwords, authentication credentials or other restricted security information. Employers are independently responsible for the personal data they process for their own recruitment purposes.

23 Service Providers

We use trusted third-party service providers to operate the Platform, including:

• database hosting;
• file storage;
• application hosting;
• identity verification.

These providers process personal data only on our behalf or in accordance with their own responsibilities where applicable.

24 International Transfers

Your personal data may be processed outside the European Economic Area where necessary to provide the Platform. Where personal data is transferred to a country that does not benefit from an adequacy decision of the European Commission, we ensure that appropriate safeguards are implemented in accordance with Chapter V GDPR, including, where appropriate, the European Commission’s Standard Contractual Clauses.

25 How Long We Keep Your Data

We retain your personal data only for as long as necessary to fulfil the purposes described in this Privacy Notice. As a general rule:

• Account and Candidate Profile information is retained while your Account remains active.
• Assessment Results and Certificates are retained while your Account remains active unless a longer retention period is required by law.
• Technical logs are retained for 3 months.
• Identity verification records are retained for 2 years.
• Following deletion of your Account, personal data will be deleted or anonymised unless retention is required by law or necessary for the establishment, exercise or defence of legal claims.

26 How We Protect Your Data

We implement appropriate technical and organisational measures to protect your personal data. While we take reasonable measures to protect your personal data, no internet-based service can guarantee absolute security.

27 Cookies

The Platform uses only cookies that are necessary for its operation, including cookies used for:

• authentication;
• maintaining user sessions;
• security.

The Platform does not currently use advertising or analytics cookies. If this changes, we will update this Privacy Notice and, where required, request your consent.

28 Automated Decision-Making

The Platform does not make automated decisions, including profiling, that produce legal or similarly significant effects on Candidates. Assessment Results are generated automatically based on predefined scoring criteria. Decisions regarding recruitment, candidate selection and employment are made independently by the relevant Employer.

29 Your Rights

Subject to applicable law, you have the right to:

• access your personal data;
• request correction of inaccurate personal data;
• request deletion of your personal data;
• request restriction of processing;
• object to certain processing activities;
• receive your personal data in a portable format where applicable;
• withdraw consent where processing is based on consent; and
• lodge a complaint with the supervisory authority in the EU Member State where you reside, work or where you believe the alleged infringement occurred.
